2. Regulations 

The program is governed by Arkansas Administrative Code 016.06.48 and follows federal regulations under the Home and Community-Based Services (HCBS) Settings Rule 

3. Licensing or Certification 

Providers must be licensed under applicable Arkansas Statutes and in accordance with state and local building codes as well as the Americans with Disabilities Act (ADA)  

4. Responsible State Agency 

The Arkansas Department of Human Services (DHS) oversees the program 

5. Application Process 

Providers must complete an enrollment process with Arkansas Medicaid. Specific details on the online or mail-in process are not available. 

6. Required Documentation 

Required documentation includes: 

• Proof of contractor licensing 

• Proposed sketch of space to be modified 

• Original photos of the site to be modified 

• Three bids if modification exceeds $1,000 

• Proof of homeownership and written permission 

7. Timeline for Approval 

Arkansas Total Care will review complete applications within 90 calendar days 

8. Pre-Application Process 

A free initial home evaluation is provided where experienced staff can visit the home and discuss needed modifications 

9. Pre-Application Training 

While not explicitly mentioned, providers must be trained in accordance with U.S. Government Lead Based Paint Removal Standards 

10. Additional Notes 

• Modifications are limited to the amount, duration, and scope described in the member's Person-Centered Service Plan (PCSP)  

• Spas, hot tubs, in-ground and above-ground pools, and walk-in tubs are excluded 

• Modifications of the same or similar type are only permitted once every 5 years unless there are extenuating circumstances 

• As of February 25, 2025, Arkansas is updating its Statewide Transition Plan to incorporate HCBS Settings regulations
