Personal Care Services New Jersey

Becoming a Personal Care Services Agency Provider in New Jersey

1.Program Definition and Services

Personal Care Services in New Jersey deliver critical in-home and community assistance to individuals with physical disabilities, chronic illnesses, or age-related conditions. The program's core goal is to maximize functional independence, enhance the participant's daily quality of life, and prevent unnecessary institutional placements by providing tailored, non-skilled care. Services include:

In-Home Personal Care: One-on-one assistance provided within the participant’s private residence (Personal Hygiene Assistance, Toileting and Incontinence Care, Mobility and Transfer Support, Medication Reminders, and Light Companionship).

Residential Personal Care: Supplemental daily support delivered within community-integrated settings (Meal Preparation and Feeding Assistance, Essential Housekeeping and Personal Laundry, Safety Monitoring and Accident Prevention, and Daily Activity Tracking).

2. Regulations

The program is governed by the following frameworks:

  • New Jersey Administrative Code (N.J.A.C.), Title 10, Chapter 60 (Home Care Services Rules).
  • New Jersey Administrative Code (N.J.A.C.), Title 13, Chapter 45B, Subchapter 14 (Health Care Service Firms Regulations).
  • New Jersey Board of Nursing Rules (N.J.A.C. 13:37-14, governing Certified Homemaker-Home Health Aides).
  • Federal Home and Community-Based Services (HCBS) Quality and Settings Standards under Section 1115 Demonstration Waivers.

3. Licensing or Certification

To legally deliver personal care services, an agency must register as a Health Care Service Firm (HCSF) with the New Jersey Division of Consumer Affairs (DCA). Within one year of registration, the firm must achieve formal healthcare accreditation from a state-approved independent body (e.g., CHAP or ACHC). Furthermore, all field staff delivering hands-on personal care must be active Certified Homemaker-Home Health Aides (CHHAs) registered with the New Jersey Board of Nursing.

4. Responsible State Agency

The New Jersey Department of Human Services (DHS), through its Division of Medical Assistance and Health Services (DMAHS) and the Division of Aging Services (DoAS), is responsible for setting personal care benchmarks and overseeing provider networks. The Division of Consumer Affairs (DCA) maintains primary licensing authority over the agency's structural registration.

5. Application Process

Providers follow a multi-step pathway. First, the business entity registers as an HCSF through the DCA online portal, paying the $500 application fee and securing a $10,000 surety bond. After achieving DCA approval and starting the accreditation pipeline, the agency enrolls as a Medicaid provider through the New Jersey Medicaid Management Information System (NJMMIS) portal managed by Gainwell Technologies under the provider type: Home Health Agency/Personal Care Assistant.

6. Required Documentation

Providers are required to compile and maintain a standard compliance folder containing:

  • Proof of legal New Jersey business formation (Division of Revenue and Enterprise Services).
  • An active DCA Health Care Service Firm Registration Certificate.
  • A certified HCSF Policy and Procedure Manual detailing RN nursing supervision workflows, clinical escalation paths, and Electronic Visit Verification (EVV) compliance.
  • Proof of a $10,000 surety bond or certified financial statement displaying a net worth greater than $100,000.
  • Certificates of liability insurance (minimum $1,000,000 commercial general liability).
  • Valid New Jersey Board of Nursing license verification for the designated RN Director/Supervisor.

7. Timeline for Approval

The timeline from initial business creation to complete Medicaid service activation typically spans 90 to 120 days. This includes the processing time for the DCA HCSF application, preparation for initial accreditation reviews, and the final 60-to-90-day NJMMIS enrollment validation pipeline.

8. Pre-Application Process

Before applying, prospective operators must organize their corporate infrastructure. This involves registering the corporate name with the state, obtaining a federal Employer Identification Number (EIN) from the IRS, and securing an organizational Type 2 National Provider Identifier (NPI) from the NPPES database under the proper home care taxonomy.

9 .Pre-Application Training

New Jersey requires enrolling agency directors and administrators to undergo foundational technical training. Agencies must integrate their billing and scheduling platforms with the state-mandated Electronic Visit Verification (EVV) vendor (HHAeExchange) and complete onboarding modules to ensure real-time verification of home care visits.

10. Additional Notes

  • All personal care services must be structured and audited under the direct clinical oversight of a New Jersey Licensed Registered Nurse (RN), including a mandatory on-site client evaluation at least once every 60 days.
  • Agencies hitting specific financial thresholds must submit audited financials: any firm receiving more than $250,000 in annual New Jersey Medicaid Personal Care Assistance reimbursement must submit a certified independent CPA audit every three years.
  • All employee files must demonstrate clean fingerprint-based Criminal History Record Checks (CHRC) and verify current Board of Nursing CHHA status before staff are placed in client homes.
  • Providers are required to track and retain 21st Century Cures Act-compliant data fields (including precise check-in times, locations, and care logs) for all Medicaid-reimbursable client interactions.
