Guide to Becoming a Respite Care Services Agency Provider in Nebraska

1. Define the Program or Service

The Nebraska Lifespan Respite Services Program, established under Nebraska Revised Statutes §§68-1520 to 68-1528, provides short-term relief to primary caregivers of individuals with special needs. The program aims to prevent caregiver burnout, reduce stress, and enhance family stability. Services include:

  • Recruiting and screening respite care providers.
  • Organizing training for providers.
  • Matching families with providers.
  • Linking families with payment resources.
  • Developing community resources for respite services.
  • Quality assurance and evaluation.

2. Regulations Governing the Program

The program is governed by:

  • Nebraska Revised Statutes §§68-1520 to 68-1528, which outline the scope, responsibilities, and funding mechanisms of the Nebraska Lifespan Respite Services Program
  • Title 175 NAC Chapter 15, which specifies licensing requirements for Respite Care Services (RCS) facilities, including operational standards, inspections, and physical plant requirements for inpatient facilities

3. Licensing or Certification Requirements

Operating as a Respite Care Services agency in Nebraska requires a license. Licensing ensures compliance with state regulations, including operational standards and safety measures. Certification may also be necessary if the agency seeks Medicaid/Medicare reimbursement

4. Responsible State Agency

The Nebraska Department of Health and Human Services (DHHS) is responsible for issuing licenses and overseeing compliance for Respite Care Services agencies

5. Application Process

The application process involves:

  • Completing the Initial License Application available on the DHHS website.
  • Printing, signing, and mailing the application to DHHS Licensure Unit at:
  • Address: PO Box 94669, Lincoln, NE 68509-4669

Applications cannot be submitted entirely online; they must include original signatures and supporting documents.

6. Required Documentation

Applicants must provide:

  • A completed application form (Title 175 NAC Chapter 15).
  • Proof of compliance with physical plant standards (if applicable).
  • Organizational charts, job descriptions, policies, procedures, and forms demonstrating compliance with operational standards.
  • Payment of licensing fees as stipulated in Title 175 NAC Chapter 15

7. Timeline for Approval

Once a complete application is received:

  • DHHS schedules an onsite inspection within 30 working days unless a later date is requested by the applicant.
  • The agency must demonstrate readiness to operate but cannot begin operations until the license is issued

8. Pre-Application Process

There is no formal pre-license application process; however, applicants are encouraged to ensure readiness before submitting their application or requesting an inspection. This includes preparing all required documentation and meeting operational standards

9. Pre-Application Training

Nebraska mandates an online orientation for respite care providers through the Nebraska Lifespan Respite Network. This training covers:

  • Basic caregiving knowledge.
  • Disability awareness.
  • Communication skills.
The orientation takes approximately one hour and provides a certificate of completion upon passing a quiz

10. Additional Notes

  • Agencies must notify DHHS in writing at least 10 days prior to any changes in operations (e.g., sale, relocation).
  • Licenses are non-transferable and tied to specific premises and personnel listed in the application
